[192] We understand that mass settlement agreements may be exclusive contracts, given that MDU owners only accept these agreements with an MVPD and exclude others from a similar agreement. Such agreements should not prevent MDU residents from choosing a competing video provider. However, due to the bulk billing nature of the contract, residents should continue to pay a fee to the provider with the mass billing contract and pay a subscription fee to the new provider. We are asking for comments on whether these “mass settlement agreements” are generally formalized as agreements between cable operators and PRIVATEOs or between PRIVATEOs and residents (or both)?
